The federal government has joined a major railroad in urging a federal judge to strike down the District’s new ban on shipping hazardous materials on rail lines through the city. In a brief filed late Friday and released Saturday, the Department of Justice lodged its objection to the District interfering with the railway transport of hazardous materials and the federal regulation of that activity. CSX Transportation sued the District government two weeks ago in an attempt to overturn the law, and the Justice Department agreed with CSX in its new legal papers that the law violates the constitutional protections afforded interstate commerce.
