A former upstate New York couple whose business computers were seized by federal agents have sued for $4.4 million, arguing that their hardware, software and entire business were trashed when investigators went after the wrong man three years ago. The suit was put on hold last week in U.S. District Court while government lawyers appeal the ruling that upheld the couple’s right to sue individual agents involved. “We moved to dismiss based upon a statute which essentially says once the action against the government is dismissed, that that is a complete bar to the action against the agents,” said Assistant U.S. Attorney Charles Roberts in Syracuse. “The solicitor general has approved this office taking an appeal.” Full Story
