A federal judge gave prosecutors until Monday to decide whether to comply with her ruling that granted alleged Sept. 11 conspirator Zacarias Moussaoui access to a key al Qaeda witness. Yesterday’s order by U.S. District Judge Leonie M. Brinkema in Alexandria does not necessarily mean that prosecutors must decide before then whether to defy the judge and refuse to turn over the witness, Ramzi Binalshibh, for a deposition by Moussaoui and his legal team. Brinkema ordered the deposition in late January, and government officials have repeatedly said they would not comply. Federal prosecutors still have the option of going back to a federal appeals court and asking it to reconsider its dismissal of their appeal of Brinkema’s ruling.
