A dispute over whether Zacarias Moussaoui has the right to be present during a court hearing next week on his access to an imprisoned member of Al Qaeda has been ended by his decision not to attend the hearing, a judge said today. Prosecutors sought on Wednesday to bar Mr. Moussaoui from the closed proceeding on the grounds that classified information would be discussed. Judge Leonie M. Brinkema of Federal District Court here has told the government that Mr. Moussaoui is entitled to information and witness statements that might prove he was not a conspirator with the hijackers who staged the Sept. 11, 2001, attacks. But prosecutors have repeatedly invoked national security concerns to keep information from Mr. Moussaoui, an acknowledged loyalist of Osama bin Laden.
