A federal judge yesterday rejected the government’s proposal for a middle ground in the latest dispute over whether alleged Sept. 11 conspirator Zacarias Moussaoui can interview top al Qaeda operatives to prepare his defense. U.S. District Judge Leonie M. Brinkema gave prosecutors until today to comply with last week’s order that granted Moussaoui access to two detainees, rejecting the government’s “substitutions.” The substitutions are the government’s versions — based on interrogations — of what the two operatives would say if they testified. The ruling sets up another likely showdown between the Justice Department and Brinkema, who is overseeing the trial of the only person charged in the United States in connection with the Sept. 11, 2001, terrorist attacks.
