Judge: No Mistrial for Accused Hijackers

A judge refused to declare a mistrial Friday in the case of six Cubans accused of hijacking a passenger plane to Key West, even though a government witness violated a deal with the defense. The testimony in question was by Border Patrol Agent Kerry Heck, who said Wednesday that alleged ringleader Alexis Norneilla Morales confessed to recruiting three co-defendants to hijack the plane March 19. The defense and prosecution had agreed not to mention the suspects’ confessions because the FBI had violated their Miranda rights by not telling them they had the right to remain silent. Full Story
