The rumpled woman in the open-toed sandals was feeling pretty good yesterday. Even for this veteran of countless battles with what she calls an oppressive government, it’s not every day that you beat the Justice Department. Especially when that same Justice Department is trying to jail you as a handmaiden to terrorists. So yesterday, Lynne F. Stewart, a leftist lawyer who defends terrorists, was savoring her court victory. On Tuesday, a federal judge in Manhattan dismissed the most serious charges against her — providing material support to terrorists — saying that the law under which she had been charged was unconstitutionally vague. She still faces two lesser charges that could put her behind bars for 10 years if she is convicted. But yesterday was a day for relief. In her office in Lower Manhattan, suitably shabby for a lawyer with radical clients, she said the ruling proved that she was not the terrorist that Attorney General John Ashcroft had made her out to be.
