A U.S. appeals court on Thursday dismissed a government attempt to block accused Sept. 11 conspirator Zacarias Moussaoui from questioning a captured al Qaeda operative, a decision that could affect whether the trial continues in civilian court. The three-judge panel of the U.S. Court of Appeals in Richmond, Virginia, dismissed the case on technical grounds, concluding that it did not have the authority to hear the government’s appeal. The U.S. District Court in Alexandria, Virginia, ruled in January that Moussaoui can question, via video conference, Ramzi bin al-Shaibah — a key al Qaeda member who is suspected of coordinating the Sept. 11, 2001, attacks on America.
