An Egyptian man will remain in jail in Toronto indefinitely simply because he’s an Arab Muslim, his lawyer said on Monday. In a written ruling, Justice Andrew MacKay agreed Mahmoud Jaballah would likely be tortured or killed if he is returned to Egypt, and has called keeping him him in jail an abuse of power by the immigration minister. A refugee claimant, Jaballah is accused by the Canadian Security Intelligence Service (CSIS) of having links to al-Qaeda and al-Jihad, groups allegedly intent on overthrowing the Egyptian government and establishing an Islamic state. Arabs living in Canada can take one message from the case, says lawyer Rocco Galati: “You don’t have any constitutional rights.” He has been in jail for 23 months, held without charge on a security certificate signed by then solicitor general Lawrence MacAulay and immigration minister Elinor Caplan.
