Federal prosecutors failed Thursday to work out a compromise with a judge who has ruled that Zacarias Moussaoui — the only person charged in the USA in the Sept. 11 conspiracy — can question a captured al-Qaeda member he says can clear him. U.S. District Judge Leonie Brinkema rejected a proposal by prosecutors, saying it would not be comparable to the videotaped deposition of al-Qaeda captive Ramzi Bin al-Shibh that she ordered in January. The failure means that the case’s fate rests with the U.S. Court of Appeals for the 4th Circuit in Richmond, Va., which had asked Brinkema to try to broker a compromise. Arguments are set for June 3.
